Thank you frostrated and madmonkey for your responses. We had taken infopass and were able to speak to immigration officer too. That is where we were told there is nothing like linking or interfiling. I read the pearson memo multiple times but it says both dates must be current. EB2 is not current and hence do not know the validity of the claim. I will try infopass again and see before filing MTR.

We are a canadian family who moved to the US about 10 years ago. We are US permanent residents; all have green cards. My husband lost his job in the US last month and we are currently staying with family in Canada until my husband gets another job. But this other job may be in Canada or in the US again. Until he gets an answer and we relocate, we would like to put our children in school so they don't fall behind by the time we get to our next destination - which could be about another month or so. If we place our children in canadian schools until then, will this jeopordize our green card or status?

Hello, my application was filed on July 11 and reached USCIS on 12 th (TSC). Speaking to an officer at USCIS I found that my application has been rejected on Sep 11, 2007 due to missing filing fee. He said, I can try re-filing my case with that letter they sent, a letter explaining the situation (guess an apology letter from our end) and a new check. But, he did mention honoring the application would be at the discretion of the immigration officer.
I still haven't received the rejection letter yet. Has anyone been through a similar situation. If so, can you please tell me if they would honor my re-filing ? Please let me know your thoughts.

My case cannot be processed under CSPA, because the form I-824 was not filed within one year of the visa becoming available.

If the principal applicant adjusted status in the U.S. and a derivative is applying for a visa abroad to follow-to-join, then the date on which the derivative will be considered to have sought LPR status for purposes of satisfying CSPA Section 3 will generally be the date on which the principal (acting as the derivative beneficiary's agent) filed the Form I-824 that is used to process the derivative's following to join application. Therefore, in cases involving a derivative seeking to follow to join a principal who adjusted in the U.S., the derivative can benefit from the CSPA if the principal filed a Form I-824 for the beneficiary within one year of a visa becoming available (i.e., within one year of the case becoming current or petition approval, whichever is later). The instructions to Form I-485 (the adjustment application) advise aliens adjusting status in the U.S. who have derivatives abroad to file a Form I-824 for such derivatives, and the I-485 Form indicates that that Form I-824 can be filed simultaneously with the Form I-485

Get it Notarized with photo and send the document.There are standard formats available.
If it is Power of Attorney to deal in property matters on your behalf, then the notarized copy also needs to be stamped by the Indian Consulate in your area.
So there is one more loop involved - to get it endorsed by Indian Consulate, after you have done the notarization. I believe this is something that has become applicable recently as I had to do it last month. A few years ago when I had done the first one, it was just preparing the POA document, and getting it notarized.

Why not microsoft? The rest of high tech industry will not survive if they can't move their 60% of operations outside of USA. Bone headed congress will continue to come up with legislation that encourage illegal immigration and discourage legal immigration. Sounds like 19th century for UK, 20th century for USA and 21st century for China and India. Dollar declines and what is the use of GC? I am thinking of going back where the growth is.

I would appreciate if you could help on this.
I last entered in US using AP and currently working on EAD . My H1 is going to expire in April 2010. I am thinking of renewing it to provide a backup in case anything happens to my 485. I have to go to India in July 2010 and I would like to come back using AP. Pleass let me know which of the following option is best for me.
1. Renew my H1 now and go to India n July and come back using AP.I understand that in this case, if I have to use H1, I would have to go to India and get it stamped.
2. Come back from India in July and renew my H1 after I come back. Is this possible to renew the H1 after it expires and do they give you a I94 in this case?
Please let me know what you think. I need to decide ASAP.
