This action simply contradicts the entry on visa waiver. This allows people to visit (ONLY) with no intention of staying.
Coming in before you know your L visa is going to be coming is fraudulent.
If this individual wishes to leave the US they will have to get the L visa stamped in their passport before they can return. Might be asked why they did not get this done to enter the country for their job in the first place.
Have to say this person is going to need some assistance at some point to explain this away.

I live in the Denver-Colorado Area and myself and lot of my other friends went to the USCIS office at 8AM on a saturday, one before the schduled appointment
They made us wait for about 30 minutes extra, till they could finish the current filers
After that we were called and had our fingerprinting done
I would suggest, go there over the weekend and get it done with

Great Job vine93. In addition to telling your story of sufferings,disappointmenst becsue of the retrogression also get some talking points from IV maybe Pappu can provide you some, not that you need any, everyone of our sufferings are talking points by themselves. Please convey them how people from India are waiting for 10+ years without any chance of GC in sight and have to wait for another decade or so to get there green card. Good luck, I have called my congressman and vented my frustrtaion at how people from India china are suffering because of country quota and because of recapture of visas not happenning.

since then I have a valid H1 and is expiring in 2008 oct.
for this Q what do I ans Yes or no?

Check page number 9. It speaks about Interim EAD, and this document expires on 08/31/08. If they have stopped issuing Interim EADs how come it says the opposite on this document. Just wondering:confused:

I actually did the stop payment back on the 14th and I have checked my account everyday and nothing...... Do you think they will reject it? I hate to lose the receipt date of July 2nd....
If there is no way you can stop the stop payment, then you should not get all anxious.
You were considering yourself lucky that your PD became current in July, unlucky that you filed a day too soon, but lucky that you came to know just in time, lucky that you still got your receipt, unlucky that you stopped payment, lucky that you have a second application in case your first one is rejected....
So you started being lucky and you might end up being lucky... Don't worry about all the unlucky episodes in between and hey, why worry about losing just 6 weeks of receipt date. Think about pre June-15th days :):)

Thats is the law. They have to provide no matter how much blood suckers they are. Of course it depends on how you make them realize that.
I was offered one when i was in that situation way back in 99.
Its as per law. But in practice, we do not see it happening much. maybe I am not aware. Anyway getting a flight ticket back to home country is not an issue for a great discussion :)

Do you want to tell us your employer name? It helps other people...if u don't like u can ignore it.
I had similar situation where on H1B he was showing different salary...but he was paying less..difference is almost $10000 per year...it is between Aug 2003 and Oct 2004...Can we do anything now?
My previous two employers have also paid me less than what they have mentioned

Hello All,
Employer A filed my I-140 and it was approved. They refused to provide me the approval notice but provided me the receipt#.
Later I moved to company B. Now company B is starting my green card process.
They said I can port my priority date If I have the I-140 approval notice.
My questions are
1) Is it possible to request USCIS a duplicate copy of my I-140 approval notice
using either g-639 (FOIA) or I-824 (Action on an approved application or petition) or any other method as I have my receipt#?
2) I don't know whether or not employer A revoked my I-140. Can I used it
to port priority date even if my I-140 is revoked?

I got mine in 3 months non premium processing for H1 extension (1st 3 years over so applied for second three years) same employer, same profile. So basically the most straight application you can put.
